PER COURT :- 1.
The petitioner is aggrieved by the judgment of the Industrial Court dated 30.7.2003, by which his Revision (ULP) No. 26 OF 2003 was dismissed and the interim order dated 16.4.2003, passed by the Labour Court, below Exhibit U-2 has been sustained.

I have heard the learned Advocates for the respective sides at length.

By an interim order dated 28.8.2003, passed by this Court, the services of the petitioner were protected. The said protection has continued for about 13 years.

In the light of the above fact, I deem it proper to continue the akl/d
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD 2 - WRIT PETITION NO. 3265 OF 2003 interim protection granted by this Court on 28.8.2003 till 31.3.2017 and direct the Labour Court, Nanded to decide Complaint (ULP) No.12 of 2003, which was earlier before the Labour Court, Jalna and is now transferred to the Labour Court, Nanded.

Needless to state, the Labour Court, Nanded shall decide the Complaint as directed on or before 31.3.2017 and shall be at liberty to refuse adjournments to the litigating sides if the same are based on unreasonable grounds.

This petition is, therefore, partly allowed and Rule is made partly absolute.
7.
Consequentially, Civil Application No.7766 of 2016 does not survive and stands disposed off.
