Heard learned counsels for the respective parties. 2.
By way of present writ petition, petitioner assails the order dated 27.09.2022 passed by 6th Joint Civil Judge, Junior Division, Latur, below Exhibit-5 in R.C.S. No. 718 of 2021, thereby application filed by the petitioner came to be rejected and said order was confirmed in appeal by the appellate authority.

Learned counsel for respondent No. 2 submits that now the suit is at the advanced stage and parties have already led the evidence. He submits that the evidence of petitioner/original plaintiff is recorded. Bhagyawant Punde

In view thereof and considering the stage of the suit and more particularly the fact that orders of both the Courts are against the petitioner, I am not inclined to entertain the present petition under Article 227 of the Constitution of India.

Writ petition is therefore dismissed. No order as to costs. 6.
