IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 927 WRIT PETITION NO. 4173 OF 2016 MOHD HABIB MOHD MAULANA

VERSUS

THE ELECTION OFFICER AND OTHERS ---- Shri. J.M. Murkute, Advocate, for petitioner. ---- Coram: T.V. NALAWADE & SANGITRAO S. PATIL, JJ.

Date: 9 February 2017 ORDER:

The petition is filed for giving directions to the Court before whom Election Petition No.8/2012 is pending to challenge the election of the councillor, one of the present respondents and it is the contention that no progress is made and the matter needs to be expedited. In view of the contentions, report of the Presiding Officer was called and it shows that present petitioner took four years for adducing and completing his evidence.

2 WP 4173 of 2016 2) In view of the approach of the petitioner the Court cannot be blamed. However, considering the necessity to expeditiously dispose of such proceeding, this Court holds that some direction needs to be given to expeditiously dispose of the proceeding. Submissions made show that tenure of the present councillor will be over in October 2017. In view of these circumstances direction is given to the Court to decide the proceeding within three months from the date of receipt of the order. The petition is disposed of in those terms. Authenticated copy is allowed.
