It is submitted by the learned Advocate for the Applicants that since the original claimant died, the amount for printing charges was not deposited and, therefore, the learned Registrar (Judicial) passed the order and the Appeal came to be dismissed in default. He submits that, in Civil Application No. 6455 of 2023 in RC/967/2012, this Court by order dated 18th August, 2023, allowed the said application by imposing costs of Rs. 2,000/-. He submits that, similar order be passed. 2.

The learned AGP submits that the Applicants shall not be entitled to claim the interest and statutory benefits for the delayed period.

After hearing both the sides and for the reasons mentioned

2 929CA12247.2025.odt in the Application, the Application is allowed subject to payment of costs of Rs. 2,000/- [Rupees Two Thousand] to be paid with the office of the High Court Legal Services Sub Committee, Aurangabad Bench. 4.

The Applicants shall not be entitled for the interest and the statutory benefits for the delayed period. They shall give an undertaking in that regard.

The Application stands disposed off.
