Present writ petition has been filed for directions to respondent No.2 to decide the application for premature release of the petitioner within the time frame.

Learned APP is producing the chart given by the Superintendent, Open Prison, Paithan, where the petitioner is lodged. The said report is taken on record by marking as Exhibit-'A' and as per the calculation given, the petitioner has undergone 13 years 10 months 8 days imprisonment. It is also stated that his 14 years would be completed on 22.01.2025. [1]

It appears that the proposal was sent to the State Government on 29.11.2024. Definitely, it takes time to undergo the entire procedure as reports and the opinion from various authorities are required to be collected before the decision is taken.

Learned APP, upon instructions, submits that after completion of 14 years of imprisonment of the petitioner, the State Government will start the further procedure and would complete it as expeditiously as possible.

In view of the said statement, we dispose of the writ petition with directions to respondent No.2 to take up the said proposal for premature release of the petitioner as early as possible after completion of the 14 years of imprisonment.
