Shri. U. R. Awate, learned counsel for the petitioner submits that, subsequent to filing of the present writ petition, the examination was postponed and as such the prayer clauses A and B do not survive. The learned counsel submits that, respondents No. 3 and 4 are required to abide by the schedule of examination as prescribed under Section 80 of the Maharashtra Public Universities Act, 2016 and the University is required to publish the examination program at the start of the academic program itself.

The University is supposed to act in consonance with the the provisions of the statute. Naturally the provisions of the Statute are required to be abided by the authorities and if any infraction of the provisions is there, then the aggrieved party can have a grievance. Suffice to observe, that the respondent shall abide by the provisions of the statute, acts, ordinances and regulations applicable to it. 3.
