At the outset, the learned Advocate for respondent No.1 states that the petitioners are having alternate remedy available u/s 29 of the Protection of Women from Domestic Violence Act, 2005. Therefore, the petitioners ought to have file the appeal before the Appellate Court.

In view of the said legal position, the petitioners are seeking permission to approach the learned Appellate Court. Permission is granted. The writ petition is disposed of in view of the aforesaid khs/Sept,2025/1925

The time spent in this Court till passing of this order shall be considered as a ground for seeking condonation of delay. 4.

Mr.Yogesh Birajdar, the learned Advocate is appointed for respondent No.1 through the High Court Legal Aid Sub Committee, Aurangabad. Fees be quantified and paid to the appointed learned Advocate as per rules.
