Heard learned counsel for respective parties. 2.

By way of present petition, the petitioners assail the order dated 31.12.2021 passed by the learned Collector, Aurangabad in Prakaran No.2021 Appeal/MLRC/CR-117 and the order dated 31.05.2022 passed in Prakaran No. 2022/ROR/REV/CR-32 by the learned Divisional Commissioner, Aurangabad.

Mr. Korade, learned AGP raised a preliminary objection about maintainability of the present petition by pointing out that the petitioners are having alternate efficacious remedy of filing second revision before the State Government. In support of his contention, he relied on the judgment of the Hon'ble Supreme Court in the matter of Gurudassing Nawoosing Panjwani Vs. State of Maharashtra and Others reported in 2015 AIR SCW 6277.

In view of the law laid down by the Hon'ble Supreme Court in the matter of Gurudassing Nawoosing Panjwani (supra), the petition is disposed of as not maintainable.

The petitioners are at liberty to file revision before the State Government within a period of eight weeks from today. The time spent while prosecuting the present petition shall be taken into consideration by the State Government while considering the application for condonation of delay.
