The learned Advocate for the Petitioner has collected instructions and submits that the Petitioner will prefer a second revision under Section 247 of the Maharashtra Land Revenue Code before the appropriate authority in view of the law laid down by the learned Division Bench of this Court in the matter of Gurudassing Nawoosing Panjwani vs. State of Maharashtra and others, Letters Patent Appeal No.55/2003 in Writ Petition No.7477/2002 (Mumbai) decided vide judgment dated 13.07.2005. A request is made that the time spent in this Court may be excluded in order to condone the delay, if any. The learned Advocate for Respondent No.1 and the learned AGP have no objection.

*2* 905wp14883o17 As such, this Writ Petition is disposed of with liberty to the Petitioner to avail of a statutory remedy. Time spent in this Court from 10.11.2017 till the passing of this order shall be excluded and shall be a good ground for condonation of delay provided the Petitioner prefers the second revision within three weeks from today. kps (RAVINDRA V.
