Heard learned Counsel appearing on behalf of the petitioners at length. He submits that, delay of 62 days, which is condoned by the learned Sessions Judge, is without any basis and bona fides. 2.

In my opinion, once the learned Sessions Judge has exercised its discretion considering the cause stated before it, no interference is called out.

In support of his contention, learned Counsel appearing on behalf of the petitioners relied upon judgment of this Court in the matter of Kamalbai w/o Narasaiyya Shrimal & anr. Vs. Ganpat s/o Vithalrao Gavare reported in 2007(1) Mh.L.J.

It is required to be noted that the cause cited in the application was considered to be sufficient cause by the learned Court below. Hence the foundation laid down in the above referred matter, is of hardly any assistance.

In view of above, no case for interference is made out. Petition fails and stands dismissed.
