Respondent No.2 in person has pointed out copy of judgment passed by the Sessions Court in Criminal Revision No.238 of 2016 on 3rd December, 2016. In Criminal Revision No.238 of 2016 the State of Maharashtra had challenged the same order, which is challenged in this writ petition and by judgment dated 3rd December, 2016, the Sessions Court has allowed the Revision.

In view of the above, the learned Advocate for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to raise the challenge, raised in this petition, in appropriate proceedings at appropriate stage, if required. The petition is disposed as withdrawn with liberty as prayed for. No costs.
