The applicant is seeking regular bail in Crime No. 01 of 2015, registered with Ambajogai Police Station, Dist. Beed for the offences punishable under Sections 302, 201, 120(B) read with 34 of the Indian Penal Code.

It is the case of the applicant that, the brother and son of the applicant are also impleaded in the crime in question and as such, case is based on circumstantial evidence and the accusations against the present applicant is that of causing a criminal conspiracy. The applicant stands on better footing than that of the other two accused, who are already

released on bail by this Court vide order dt. 23rd July, 2015 passed in Criminal Application No. 3341 of 2015. He would then urge that, on the date of alleged incident, he was in Jail in another crime. 3.

Perused the FIR and order dt. 23rd July, 2015 passed by this Court in Criminal Application No. 3341 of 2015. 4.

It is an admitted fact that, the case of the applicant is on better footing than that of the other two accused, who have already been released on bail by this Court. The number plate of vehicle belonging to accused No. 2 was found in forest whereas; the present applicant was behind bars in another crime, which was registered at the best of deceased - Sunita.

In view thereof, it will be appropriate, in my opinion, to order release of the applicant on bail. Hence, I pass the following order.

ORDER

The applicant Jairam Rambhau Chaughule be released on bail in Crime No. 01 of 2015, registered with Ambajogai Police Station, Dist. Beed for the offences punishable under Sections 302,

201, 120(B) read with 34 of the Indian Penal Code, on his furnishing P.R. bond in the sum of Rs. 15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. 6.
