The present application is filed for seeking transfer of P.A. No. 2493/2021 filed by the Applicant against Respondent before Family Court, Pune for restitution of conjugal rights.

Applicant claims that marriage between her and Respondent was solemnized on 17.12.2020. Applicant now contends that in view of the change in the circumstances, the proceedings filed at Pune be transferred to Ahmednagar. It is contended by the learned Counsel for the Applicant that she is unemployed and on account of ill-health of her mother also she finds it difficult to attend proceedings at Family Court, Pune. It is his further submission that

965-MCA-321-2023.odt Domestic Violence proceedings bearing Criminal M.A. No. 352/2021 is pending at Pune and the Applicant intends to seek transfer of the said proceeding too by filing appropriate application.

Learned Counsel for Respondent records no objection for the transfer of the P. A. No. 2493/2021 for the reason that the Respondent is also resident of Ahmednagar. Thus, there is no impediment in allowing application.

Learned Counsels for both sides, on instructions, make joint request for transfer of Criminal M.A. No. 352/2021.

In view of above, Application is allowed in terms of prayer clause 'B'. Learned JMFC, Khadki, Pune also is directed to transfer Criminal M.A. No. 352/2021 to Ahmednagar for its decision as per law.
