Heard learned counsel for the applicant.

Inspite of service, no appearance is caused on behalf of the respondent. In the circumstances, averments in the application go uncontested and uncontroverted. Absence on behalf of the respondent, to a large extent, reflects upon intention of the respondent, not to resist the transfer of proceedings, sought under the application.

Learned counsel for the applicant refers to various difficulties being faced by the applicant in attending to the proceedings of which transfer is sought, to a competent court at Ahmednagar.

There is no resistance to the claims made by the learned counsel for applicant.
