CORAM:

S.S. SHINDE AND A.M. DHAVALE, JJ.

DATED :

22nd December, 2018.

ORAL ORDER :

1.

This petition is filed seeking directions to respondent No.2 to declare the results of Maharashtra Civil Engineering Services (Mains Examination-2017).

(( 2 )) 2.

Learned counsel for the petitioners submits that, the respondent No.2 has not declared the results of said examination by citing the reason that in the case of Monika Mhatardeo Dhayastadak (Writ Petition No.4497/2018 and connected Writ Petitions thereto), the High Court, on 4.5.2018, granted stay for said declaration of result. Learned counsel for the petitioners invites our attention to the order passed by this Court (Coram : R.M. Borde & K.K. Sonawane, JJ.) dated 4.5.2018 and submits that, in the said order, there is nothing to indicate that the result should not be declared. It is observed that the interim relief granted in that case would be subject to final outcome in that petition. Learned counsel also invites our attention to the Government Resolution dated 19.12.

2018, issued by the General Administration Department, Government of Maharashtra and submits that, it is clarified by the State Government that even candidates from reserved category can be considered from open category. In short his submission is that, there is no impediment for the respondent No.2 to declare the result of aforesaid examination. 3.

We clarify that there is no stay granted by this Court in the aforesaid Writ Petition No.4497/2018 for declaration of the results. In the light of observations made hereinabove, the respondent No.2 to take necessary further steps forthwith.

(( 3 )) Petitioners to approach the respondent No.2 with the copy of this order. With the above observations, Writ Petition is disposed of. 4.

Learned A.G.P. assures this Court that this order will be communicated to the respondent No.2 through the office of the Government Pleader forthwith.
