Heard the learned counsel for the applicant and learned A.P.P for the respondent State.

The applicant has been arraigned as an accused on the sole reason of having together in bar with the deceased. However, after having drunk in the bar the accused and the deceased dispersed and then the incident happened. Only on the basis of this evidence, the applicant was arrested. However, nothing has been recovered from him to complete the chain of circumstances. Investigation has been completed. There are no antecedents to the discredit of the applicant. In view of that matter, keeping the applicant behind bar would serve no purpose. Hence the order.

ORDER

(I) The bail Application is allowed.

(ii) Applicant Nilesh Ramesh Nikam be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand) with one solvent surety of the like amount in Crime No. 89 of 2022, registered with Nimbhora Police Station, for the ofence punishable under Sections 302, 201, r/w 34 of the Indian Penal Code on the condition that he shall not tamper with the prosecution witnesses.
