IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 87 OF 2016 Sabiha Begum Mahmood Khan .. Petitioner

Versus

The Additional Collector, Nanded And Others .. Respondents Smt. A. N. Ansari, Advocate for the Petitioner. Mr. B. B. Bhise, AGP for Respondent Nos. 1, 3 & 4. Mr. Vijay V. Deshmukh, Advocate for Respondent No. 2. CORAM : KISHORE C. SANT, J.

DATE : 03rd NOVEMBER, 2025.

PER COURT :- 1.

Heard the parties for long time.

2.

Smt. Ansari, learned advocate for the petitioner strenuously submits that, all the authorities have wrongly recorded the findings and the reasoning. Therefore, the petition needs to be allowed. She further submits that, Writ Petition No. 283/1997 is in respect of the same subject matter and between the same parties and this petition needs to be taken along with the said writ petition.

2 19-wp 87-2016.odt 3.

The learned advocate for respondent No. 2 strenuously submits that, there is no merit in the writ petition and the same deserves to be dismissed.

4.

This Court has gone through the orders. There is no dispute that, when the mutation entries in favour of the petitioner was taken on 29.01.2010, there was already status quo granted by this Court in Writ Petition No. 283/1997 on 13.10.2006. In view of this, this Court does not find any merit in the present writ petition. The Writ Petition No. 283/1997 is to be decided on its own merits. This Court also does not find any reason as to why this petition needs to be heard along with Writ Petition No. 283/1997 which is already admitted by this Court. Everything is ultimately subject to outcome of Writ Petition No. 283/1997. 5.

Considering above, this Court finds that, keeping this petition pending would be of no use. In view of the same, the present writ petition stands dismissed. No order as to costs. ( KISHORE C. SANT, J. ) P.S.B.
