Without moving any application to the Family Court, requesting for taking up the matter and deciding it out of turn, the petition has been filed with a request for issuing writ of mandamus directing the Family Court to decide the proceeding at the earliest.

The petitioner has been bold in invoking the powers of this Court under Articles 226 and 227 of the Constitution of India. It is a gross abuse of process of law. Though the learned
592.25wp (2) advocate for the petitioner perhaps sensing a drastic order, seeks leave to withdraw the writ petition, we refuse it. 3.
The writ petition is dismissed with costs of Rs.3,000/- to be deposited by the petitioner in this Court within a period of three weeks, failing which, the money shall be recovered as arrears of land revenue.
