Learned Advocate Mr. K. M. Nagarkar holding for learned Advocate Mrs. Smita S. Kulkarni now seeks withdrawal of this application, in view of the prayer clause that was made and after query was made as to why an application for recall or review, if maintainable, was not filed.

Here, in Civil Application No.12200 of 2025, following prayer is prayed :- "B.
Declare that the direction for registration of FIR passed by this Hon'ble Court in Criminal Writ Petition No.791 of 2024 has been obtained by suppression of material facts and is inconsistent with the interim protection granted by this Hon'ble Court vide order dated 12.06.2025 in the present petition."

It appears that the Coordinate Bench of this Court in Writ Petition No.7038 of 2025 with companion matters had directed that no coercive action shall be taken against the petitioner by order dated 12.06.2025. Thereafter, in Criminal Writ Petition No.791 of 2024 dated 15.10.2025, the petitioner was given liberty to approach Police Inspector of Shirdi Police Station and respondent No.5 was directed to lodge the FIR. Accordingly, it appears that the FIR bearing Crime No.936 of 2025 has been lodged on 17.10.2025 with Shirdi Police Station, District Ahilyanagar. Now, the present applicant wants declaration that the directions given for registration of the said FIR by this Court has been obtained by suppression of material facts. The prayer clause 'B' cannot be entertained since the order in Criminal Writ Petition No.791 of 2024 dated 15.10.2025 has been passed by the Coordinate Bench. We would have imposed cost on the applicant for taking out such application in the [2]
present matter, however, taking into consideration the averments made, we are restraining ourselves.
