The vehicle has been seized for illegal transportation of sand. The penalty is also imposed upon the petitioner. As far as the penalty is concerned, the petitioner has alternate remedy available and we are not inclined to consider the case of the petitioner so far as the penalty is concerned.

As far as seizure of the vehicle is concerned, the same appears to be by the incompetent authority.

In the light of the above, the respondents shall release the vehicle of the petitioner seized under the Panchanama dt. 04.08.2018 (Exh. A, Page 10) after verifying the papers and execution of the bond of the amount equivalent to the value of the vehicle.
