PER COURT :- 1.

Heard learned counsel for applicants and learned counsel for acquiring body. Perused the contents of the application, the impugned judgment and award and the grounds of objections raised in exception to the impugned judgment in the memo of appeal. 2.

In view of the above, following order is passed, -

ORDER

i.

The applicants are permitted to withdraw 50% of the deposited amount on submitting an undertaking to the satisfaction of Registrar of this Court.

ii.

The applicants are further permitted to withdraw 25% of the deposited amount on furnishing BDV

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD solvent surety/security in the like amount to the satisfaction of Registrar of this Court.

iii.

The balance 25% of the amount be invested in Fixed Deposit Receipt in any Nationalized Bank for the period till disposal of the appeal.

iv.

The Civil Application stands disposed of.
