Civil Application No. 12397 Of 2025:- 1.

The applicant has cleared her M.B.B.S. Degree and now she is aspiring for post graduate course admission. She is hoping to get admission to M.D. Course from Open category, but as her caste claim is invalidated by the Scrutiny Committee, the University is not releasing her documents i.e. M.B.B.S. Degree Certificate, Leaving Certificate, SSC Mark-sheet, HSC Mark-sheet and other relevant documents submitted by the applicant while securing admission to the M.B.B.S. course. Hence, this application. 2.

Heard learned advocate for applicant and learned AGP for the State and learned advocate for respondent No.4 University. 3.

The applicant has relied upon order passed by this Court SVH

2 911-CA-12397-25.odt on 10/06/2022 in Civil Application No.7966/2022 whereby applicant was permitted to file an undertaking that she will not claim benefit of the said caste and she will apply from Open category henceforth. Reliance is also placed on the orders passed by the Apex Court in Petition for Special Leave to Appeal (C) Nos.17179-17180 / 2021 (Saurabh Vs. State of Maharashtra and Others) and Civil Appeal No(S). __/2025 (Ajay Dattatraya Bandewad Vs. The State of Maharashtra and Others), which according to the applicant are passed in similar situations. So also, the applicant has relied upon the order dated 29/09/2025 passed by this Court in Civil Application No.10681/2025 (Khan Mohammad Mohaddis Ali Vs. The State of Maharashtra and Others).

Indeed, the applicant's case is covered by the orders passed by the Apex Court as well as the order dated 29/09/2025 passed in Civil Application No.10681/2025. In that view of the mater, civil application is allowed in terms of prayer clause 'B'. Writ Petition No. 11462 Of 2021:- 5.

Leave is granted to amend and correct the name of respondent Nos.2 and 3. Amendment to be carried out within two weeks from today.
