The applicant prayed for condonation of delay of 109 days caused for lodging the appeal on the ground that due to his unsound financial capacity, he could not approach this Court within the stipulated period and he is having good case on merit. The non-applicant nos.1 and 2 have not seriously objected for condonation of delay. Therefore, considering the nature of claim, it would be just and proper to condone the delay of 109 days caused while lodging the appeal, however, the applicant shall not claim interest for

( 2 ) 937 ca 550.18 the delayed period. Accordingly, I proceed to pass the following order:

ORDER

I) The application for condonation of delay is hereby allowed. II) The delay of 109 days is hereby condoned. The applicant will not be entitled for the interest on the delayed period. III) The Registry is directed to register the first appeal and place it before the Court for further action.
