Applicant apprehends arrest in Crime No.374/2022, registered with Aundha Nagnath Police Station, Hingoli, for offences punishable under Sections 304(B), 306, 498(A), 323, 504, 506 r/w 34 of the Indian Penal Code.

FIR is lodged by Manohar Sawant, father of deceased Shivani, alleging that marriage of Shivani was solemnized with Govind, on 14/05/2022. He paid dowry of Rs.4 Lakhs and 4 Tolas gold. He also gave household articles in the marriage. Initially, for some days his daughter was treated well and thereafter from last three months, the in-laws started ill-treating Shivani on the ground that she cannot cook properly and she is not good looking, she was abused and starved by in-laws. She was asked to bring Rs.5 Lakhs from her parents to purchase Jeep. On 08/11/2022, message was received that Shivani was missing and her footwear was found near well. When informant went there, he learnt that Shivani has SVH
2 12-ABA-1707-22.odt committed suicide by jumping in the well. He, therefore, lodged the FIR.

Heard learned advocate for applicant and learned Additional Public Prosecutor for State. Perused the investigation papers.

Three accused are named in the FIR, out of them accused No.1 husband and accused No.2 father-in-law are arrested and they are in jail. Accused No.3 applicant is mother-in-law. Investigation appears to be almost complete. Considering the omnibus allegations made in the FIR and role attributed to applicant, pre-trial custodial detention of applicant is not warranted. 5.
Applicant was directed to attend concerned police station and cooperate in the investigation, while granting interim protection. Applicant has attended the police station and cooperated in the investigation. Nothing is to be recovered from applicant. Applicant being a woman is entitled for protection. 6.
In the result, application is allowed by confirming interim order dated 15/12/2022. Till filing of charge-sheet, applicant shall attend concerned police station as and when called by investigating officer. Applicant shall not tamper prosecution evidence.
