1] Heard learned counsel for the petitioner.

2] The petitioner seeks directions against the respondents to consider the pending proposal of the petitioner since 2005 for opening Marathi medium secondary school.

3] Learned AGP states that now in view of the The Right of Children to Free and Compulsory Education Act, 2009, the petitioner will have to comply with the provisions of the said Act.

WP 436/11 - 2 - 4] Considering the fact that the proposal of the petitioner is of the year 2005 and now the petitioner would be required to comply with the conditions of the The Right of Children to Free and Compulsory Education Act, 2009, it would not be possible to accept the request of the petitioner to direct the respondents to consider the proposal of the year 2005.

5] In the light of the above, the writ petition is disposed of. No costs. The petitioner may file a fresh proposal in accordance with law as may be permissible. If such proposal is filed, the respondents shall consider the same expeditiously as per its policy, norms and the legal provisions.
