IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 924 CONT. PETITION NO.756 OF 2019 RASHID KHAN NHANNE KHAN

VERSUS

THE STATE OF MAHARASHTRA, SUNIL PORWAL T/R SECRETARY HOME DEPT., MANATRALAYA, MUM ...

Advocate for Petitioner : Mr.Talhar Ajay G.

AGP for Respondent No. 1: Mrs. V.S.Chaudhary ...

CORAM : T.V.NALAWADE, & M.G.SEWLIKAR, JJ.

DATE : 07th JANUARY, 2020.

PER COURT :

During the arguments learned counsel for the petitioner drew attention of this Court to the Government Resolution (In short 'G.R.') dated 11.12.2019, issued by the Home Department of the State Government. This G.R. shows that the Government has made provision of Rs. 110 Crore for giving facility of CCTV system to each Police Station. The G.R. also shows that the CCTV footage will be preserved for one year. This Court wants to see that when the applications are moved by the aggrieved persons in respect of atrocities in the police stations and they want to get the CCTV footage, when the application is pending before the Information Officer or the Appellate

cp756.19 Authority or even before this Court or the Supreme Court, the CCTV footage in respect of that period also to be preserved. It appears that the Circular in that regard is also issued and this Court hopes that that circular is also followed.

2.

Learned APP made statement that before 20th June 2020, on instructions affidavit of Additional Chief Secretary the systems will be supplied and work will be completed by the end of June, 2020. This Court holds that present proceeding can be disposed of. This G.R. is taken as undertaking of the Government. If is not completed, it will be open to anybody to come to this Court again in Contempt proceeding. The petition accordingly disposed of. [M.G.SEWLIKAR, J.] [T.V.NALAWADE, J.] mahajansb/
