Heard learned Counsel for the respective parties. 2.

The petitioner challenges the order dated 10.08.2022 passed below Exhibit O-3 by the learned Industrial Court, Jalna in Revisiona (U.L.P.) No.07/2021, whereby the revision filed by the petitioner came to be dismissed.

The present proceedings arises out of the show-cause notice dated 24.08.2012 and dismissal order dated 09.10.2021 issued against the petitioner. It is submitted that during the pendency of the revision filed by the petitioner before the competent authority, the petitioner was informed that his services had been terminated.

Therefore, with liberty to challenge the order of termination before the learned Labour Court, this Writ Petition can be disposed of. 5.

In view thereof, the Writ Petition is disposed of with liberty to petitioner to file a complaint before the learned Labour Court to challenge the order of termination.

It is made clear that the time spent in pursuing the revision as well as in prosecuting this petition shall be taken into consideration by the learned Labour Court, while considering the application for condonation of delay.

All issues are kept open.
