This petition is filed in the year 2019 challenging judgment and order passed by the learned District Judge-1, Kopargaon dated 19.09.2019 dismissing Misc. Civil Application No. 52 of 2014. Said Misc. Civil Application was filled challenging an order passed by the learned Civil Judge, Junior Division, allowing application below Exh.5 restraining the present petitioner/original defendant from carrying out any construction activity in the suit premises and application Exh.18 came to be allowed appointing Court Commissioner. The direction to the extent of appointing Court Commissioner came to be set aside by this Court vide order dated 05.12.2017 in Writ Petition No. 11639 of 2014. 02.

Presently, the question is thus only in respect of the order dated 28.11.2014 restraining the petitioner. It is about more than 11 years that the order is in force. The suit is of 2014. This Court finds that no purpose would be served by keeping this petition pending. It would be in the interest of justice to request to the Trial Court to dispose of the

( 2 ) wp15054.19 suit itself within a stipulated period.

Therefore, this petition is disposed off. The learned Civil Judge, Junior Division, Rahata is requested to expedite and dispose of Regular Civil Suit No. 406 of 2014 as early as possible and preferably within one year from today.
