The applicant has filed the present application seeking regular bail, in connection with FIR bearing Crime No. 772/2025 dated 28.08.2025, registered with Kotwali Police Station, Ahmednagar for the offences punishable under Sections 74, 118(1), 115(2), 351(2), 351(3), 352, 324(4), 324(5), 3(5) of Bhartiya Nyaya Sanhita, 2023 and under Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012.

Notice of respondent No. 2 - victim is awaited till today. However, the applicant has filed another temporary bail application on the ground that he is required to attend the examination of 2nd 1/3
year Engineering. He has also annexed the schedule of the said examination, which is commencing from 14.11.2025 to 21.11.2025, between 02:00 p.m. and 05:00 p.m.

After going through the said application and the schedule of the examination annexed along with the application, I am inclined to grant temporary bail to the applicant on the following conditions:-
O R D E R
I.
Applicant - Om Ramesh Wani, shall be released forthwith on temporary bail for the period from today i.e. 14.11.2025 to 21.11.2025, in connection with FIR bearing Crime No. 772/2025 dated 28.08.2025, registered with Kotwali Police Station, Ahmednagar for the offences punishable under Sections 74, 118(1), 115(2), 351(2), 351(3), 352, 324(4), 324(5), 3(5) of Bhartiya Nyaya Sanhita, 2023 and under Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012, on executing PR Bond of Rs. 25,000/- with one surety in the like amount on the following conditions:- A) The applicant is permitted to remain out of custody only for the purpose of attending the examinations as mentioned above.
B) The applicant shall report to Kotwali Police Station, Ahmednagar, every evening between 07:00 p.m. and 08:00 p.m. during the period of temporary bail.

C) The applicant shall surrender himself to the jail authorities on 22.11.2025 during daytime.
D) The applicant shall not contact the informant or her family, shall not misuse the liberty granted, and shall not tamper with the evidence in any manner.

Violation of any of the above conditions shall entitle the Court to take appropriate action against the applicant, including cancellation of temporary bail forthwith.

After compliance with the aforesaid conditions, the regular bail application of the applicant shall be considered on its own merits. 6.
In the meanwhile, the learned APP is requested to direct the concerned Police Station Officer to serve notice upon the victim and obtain acknowledgment for the perusal of this Court on the next date of hearing.

The Investigating Officer is requested to make the investigation papers available and also to produce the report regarding the status of the identification parade, which is stated to have been conducted, on the next date of hearing.

Criminal Application No. 4196 of 2025 is disposed of. 9.
