PER COURT :- 1.
By this Civil Application, it is prayed that the amount of Rs.1,50,000/- deposited in the name of the father of the applicant be allowed to be withdrawn.

I have considered the submissions of the learned Advocates for the respective sides and have perused the earlier order passed by this Court dated 3.10.2017. Rs.1,00,000/- deposited in this Court is towards arrears of maintenance and Rs.50,000/- is deposited towards the travelling charges. Based on the directions to deposit, this Court has permitted the proceedings before the Vasai Court to continue till the next date of hearing.

Learned counsel for the wife, after narrating her medical / health status, submits that she is on a wheel chair and that an amount akl/d

BENCH AT AURANGABAD 2 - MISC. CIVIL APPLICATION NO. 25 OF 2017 & ANR of Rs.20,000/- per month would be an appropriate figure as conveyance charges in the form of T.A./D.A. for the wife with regard to the proceedings at the Vasai Court. Learned counsel for the respondent / husband submits that considering the rate of the private taxi operator's charge and the daily allowance for the wife to travel to Vasai, the amount which is actual and likely to be Rs.10,000/- would be a fair amount towards conveyance whenever the wife travels to the Vasai Court. This amount cannot be paid if the wife stays back at Dhule and does not travel to Vasai.

Considering the above, the Civil Application is allowed and the applicant through the GPA holder is permitted to withdraw the amount deposited in this Court. Rs.1,00,000/- would be adjusted towards the maintenance dues and Rs.50,000/- would be adjusted towards the trips that the applicant may have made pursuant to the passing of the order of this Court dated 3.10.2017.

As per the convenience of the learned Advocate of the respondent who travels from outstation, S.O. 17.1.2018 in the supplementary board, for further hearing.
