The petitioner has approached this Court challenging the judgment and order passed by the learned member of the caste scrutiny committee, Kinwat thereby rejecting the appeal of the petitioner. The petitioner had applied for issuance of tribe certificate as 'Mannervarlu'. The learned S.D.O., however, refused to grant such certificate on the ground that, no any document is produced along with the application showing the caste status of any of the near relative prior to 1950. The said order was challenged in the appeal.

The learned advocate for the petitioner vehemently argues that, the learned S.D.O. refused to grant tribe certificate on the grounds not provided in the Act. The appellate authority also failed to appreciate that, no caste certificate can be denied on the grounds not provided under the Act.

This Court finds substance in the argument of learned advocate for the petitioner. Therefore, the writ petition is allowed in terms of prayer clauses (B) and (C). The petitioner to approach the office of learned S.D.O., Degloor on 02.12.2025. The learned S.D.O. to take decision within a period of two (02) weeks thereafter .
