Heard learned counsel for the applicants, however, none present for respondent Nos. 1 to 3 though duly served. Learned counsel for the applicant submits that due to some administrative difficulties, the appeal could not be preferred within time. In view of above and for the reasons stated in the civil application, delay occurred in preferring first appeal is hereby condoned. Civil application is allowed and disposed of.

In first appeal, issue notice to the respondents, returnable on 03.03.2017. Call for record and proceedings. 3.

In so far as stay application is concerned, learned counsel for the applicant seeks time to deposit remaining amount within four weeks. In view of the said statement, stay granted earlier to continue till then.
