We have heard Mr. Thombre, learned counsel for the petitioner.

According to the learned counsel, petitioner is minority institution. The proposal was accepted by the University. The petitioner had paid the fees and also subsequently the inspection is not carried out. The same is illegal.

It appears from the affidavit filed by the State that the location where the petitioner had applied does not find place in the perspective plan.

Section 109 of Maharashtra Public Universities Act, 2018 is abundantly clear "no application for opening new college or institution on higher learning, which is not in conformity with the perspective plan prepared under Section 107 shall be considered".

In the light of above, no relief can be granted to the petitioner. Writ Petition is disposed of. No costs.
