When this matter was called out, none was present for the respondent/husband. The statement of the learned Advocate for the applicant was noted that the parties are resolving the dispute and this proceeding can be disposed off after the proceedings before the Family Court at Mumbai are withdrawn by the respondent.

After the first Session, this matter was mentioned by the learned Advocate for the respondent post lunch requesting that this proceeding be disposed off today and the respondent makes a statement to the Court that on 22/10/2018, HMP No.

3-mca-225-17.odt A-2143/2017 shall be withdrawn from the Family Court, Bandra and there shall be no request for time. The learned Advocate for the applicant wife expresses apprehension. 3.

Considering the above, the statement of the learned Advocate for the respondent/husband made on instructions, is recorded as a statement made to the Court. This proceeding is, therefore, disposed off on the condition that the respondent/husband would enter a withdrawal purshis in HMP No. A-2143/2017 before the Family Court at Bandra on 22/10/2018. In any case, the learned Judge, Family Court, Bandra shall dispose off HMP No. A-2143/2017 as withdrawn by the husband/respondent.
