Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.157/2024, dated 25/09/2024, registered at Police Station Shirur (ka), District Beed, for the offences punishable under sections 108, 3(5) of Bhartiya Nyaya Sanhita, 2023.

The informant is the sister of the deceased, Rushikesh Bhagwat Dhakne, a 22-year-old boy. According to the FIR, her brother had sold a tractor to his cousin, Ambadas Dhakne, for a consideration of Rs. 3,50,000/-. He received Rs. 50,000/-, with the assurance that remaining amount to be paid within two to three months. However, when the deceased demanded the remaining money after the due period, Ambadas Page 1 of

4 ABA 2020-2024 informed him that he would not pay. On 26/07/2024, Rushikesh consumed poison and, in a telephone call to the informant's husband, mentioned that the applicants/accused had assaulted him and threatened him when he demanded the balance amount for the tractor. 4.

Given the circumstances, the matter requires custodial investigation as the case is grave in nature. No case has been made out for the grant of anticipatory bail. The application is therefore dismissed.
