Heard the parties for some time.

This application is filed seeking transfer of matrimonial proceeding from the learned Judge, Family Court-8, Pune to the learned Judge, Family Court, Aurangabad.

It is the case of the applicant-wife that she is staying at Aurangabad with her daughter, who is studying in Senior K.G. She therefore, finds it difficult to attend the court proceeding at Pune. There is no one to accompany her to attend the court proceeding. On this

( 2 ) ground, she prays for transfer of the proceeding from the learned Judge, Family Court-8, Pune to the learned Judge, Family Court, Aurangabad. 4.

Learned Advocate for the Respondent-husband vehemently opposed the application. He filed affidavit-in-reply. The same is taken on record.

However, considering that the wife is staying with her parents and daughter. This Court finds that in the interest of justice, it is desirable to transfer the proceeding as prayed for. Application is, therefore, allowed in terms of prayer clause (B).

The applicant shall not seek unnecessary adjournments in the proceeding. If the Trial Court finds that the adjournment is unnecessarily sought, the Trial Court may pass suitable order compensating the respondent-husband.

After transfer the proceeding, the learned Trial Judge shall try to dispose off the proceeding as early as possible and preferably within one year from the date of transfer.

The Court shall also liberally consider the request of the husband, if he wants to appear through VC.

With this, application stands disposed off.
