PER COURT :- 1.

The petitioner has directly challenged the recovery certificate dated 28.7.2015 issued by the competent authorities under Section 101 of the Maharashtra Cooperative Societies Act, 1060. Learned Advocate submits on instructions from the petitioners that he does not have the funds to deposit 50% of the amount assessed.

The petitioner has a statutory remedy under Section 154 read with Section 2A of the said Act.

As such, this petition is disposed off with liberty to the petitioner to avail of the statutory remedy. The time spent by the petitioner in this Court from 14.11.2017 till the passing of this order would be a ground for canvassing condonation of delay. ( RAVINDRA V. GHUGE, J. ) ...
