Vide order dated 10/09/2015, learned Judicial Magistrate First Class, Ahmednagar had allowed the Criminal Misc. Application No.465/2013, thereby directing the petitioner No.1 to pay Rs.2000/- per month to respondent No.1/wife and Rs.1500/- each to respondent Nos.2 and 3/children. Being aggrieved by the said order, the petitioner had filed Criminal Appeal No.7/2019 before the learned Sessions Court, Ahmednagar. Learned Sessions Judge, vide his order dated 04/10/2019, dismissed the said criminal appeal, thereby maintaining the order dated 10/09/2015 passed by the learned Judicial Magistrate First Class. Being aggrieved by the said order, the petitioner is before this Court.

This petition is listed for the first time after a period of six years. On 12/11/2025, by way of last chance, time of one week was granted. Today also, learned Advocate for the petitioners is seeking time.

It is found that the petitioner is not vigilant and alert as regards his grievance. This Court can not entertain the litigants who are not vigilant and sleeping over their rights. Even, there is no instructions from the petitioners as regards they are paying amount directed by the learned trial Court or not ?

In view of the above, this petition is dismissed. No order as to costs.
