After the matters were argued for some time and it was brought to our notice that there is complete inaction on the part of the added respondents in identifying and causing removal of the encroachment, the added respondent's advocate (respondent no.4) states that in writ petition no. 11376/2016, the Chief Executive Officer will forward the proposal to the Sub Divisional Officer, Shirdi, Taluka Rahata, District Ahmednagar and thereafter the Sub Divisional Officer, Shirdi can proceed in accordance with law to remove the unauthorized

( 2 ) 925 wp 11376.16 constructions/encroachment on the Wakf property and in writ petition no. 1218/2017 the Chief Executive Officer will forward the proposal to the Sub Divisional Officer, Aurangabad and Tahsildar, Taluka Paithan, District Aurangabad and thereafter the Sub Divisional Officer, Aurangabad and Tahsildar, Paithan can proceed in accordance with law to remove the unauthorized constructions/encroachment on the Wakf property. 2.

We accept the statement made on instructions as an undertaking to this Court. The Collectors of District Ahmednagar and Aurangabad and the Sub Divisional Officers' thereafter to proceed in accordance with law and remove the encroachments as expeditiously as possible. Writ petitions stand disposed of.
