In our view, the petitioner has equally efficacious alternate remedy in the nature of filing an application under Section 156(3) of Code of Criminal Procedure. He may avail the same. Needless to mention such application needs to be decided on its own merits. 3.

With the aforesaid observations, criminal writ petition stands disposed of.
