Taking into consideration the prayers, the alternative efficacious remedy is in fact under Section 438 of the Bhartiya Nagarik Suraksha Sanhita, 2023 before the learned Sessions Judge. Under the said circumstance, learned Advocate for the applicant prays for withdrawal of the application with liberty to approach the learned Sessions Judge.

In view of the above-said submission as well as the fact, the application stands disposed of as withdrawn with liberty to approach the learned Sessions Judge.
