The State has moved this application under section 439 (2) of the Criminal Procedure Code, for cancellation of anticipatory bail granted to the respondent-accused, by learned Additional Sessions Judge-7, Aurangabad vide order dated 05/01/2023 in Crime No. 231 of 2019 registered with Bidkin Police Station, District Aurangabad for offence punishable under sections 394, 363, 341, 279, 427, 504, 506 of the Indian Penal Code.

Heard the learned Additional Public Prosecutor for the applicant and learned advocate for respondent. Perused the documents placed on record.

During the course of hearing, it is revealed that charge sheet, in the present crime is filed on 08/09/2020, and the case is numbered as RCC No. 351 of 2020. The matter is kept for framing of charge.

In the light of these developments, it is not desirable to cancel the anticipatory bail granted to the respondent - accused by the Sessions Court.

The application is, therefore, dismissed.
