When the matter is called out none appeared for the petitioner, even none appears for the Respondent No.5. With the Assistance of learned AGP, this Court has gone through the matter. 2.
The respondent No.5 was elected to the post of Member of Gram Panchayat, Nirkheda, Taluka and Dist. Jalna. The petitioner filed a complaint under Section 14(1)(J-3) of the Maharashtra Village Panchayat Act to the Collector. The learned Collector allowed the application of petitioner and held the respondent No.5 guilty of
( 2 ) 44-WP-588-2019 committing encroachment and incurring disqualification under Section 14(1)(J-3) of the said Act, by order dated 29th December 2017. The said order was challenged by the Respondent by filing an appeal before the learned Divisional Commissioner.

The learned Divisional Commissioner by judgment and order dated 28th June 2018 allowed the revision and set aside the order passed by the Collector, holding that the respondent No.5 had not incurred any disqualification.

This Court finds that respondent No.5 was elected as a member for the term of 2017-2022. This Court thus finds that present petition has become infructuous by efflux of time and the same is dismissed as such. [KISHORE C. SANT, J.] D.A.Ethape
