Learned counsel for the applicant has tendered service affidavit showing that unserved Respondent No.5 has been served by Email, RPAD and also physically. 2.

Mr. Amol Joshi has instructions to appear on behalf of Respondent Nos. 4 and 5. Other respondents are represented by counsel.

Learned counsel having instructions to appear for Respondent Nos. 4 and 5 is permitted to file Vakalatnama within one week from today.

This application is seeking restoration of the writ petition which stood dismissed for non removal of office objections as per order

909ca658-25 dated 16.01.2024 passed by this Court. Prayer is also made for condonation of delay in filing the restoration application. 5.

We have perused the contents of the application, particularly paragraphs 4 to 13 thereof. We find that sufficient cause is made out for condoning the delay and also for restoring the writ petition, but subject to payment of costs by the applicant. 6.

In view of the above, the application is allowed in terms of prayer clause (B), subject to office objections being removed within four weeks from today and further on the condition that the applicant deposits costs of Rs.2000/- with the Creche/Day Care Centre, Advocates' Association of Bombay High Court, Bench at Aurangabad within four weeks from today.

If the objections are removed within stipulated period and amount of cost is paid, the petition be listed thereafter within one week.
