By the present Application, the Applicant / Claimant prays to discharge the earlier Solvent Surety and seeks permission to furnish a fresh Solvent Surety/Security.

Heard the learned Advocate for the Applicant, learned AGP for the State and learned Advocate holding for Mr. Rahul Tambe for the Acquiring Body.

In Civil Application No. 12797 of 2021, the Applicant was permitted to withdraw 50% amount of compensation without any condition and remaining 50% on furnishing Solvent Security to the satisfaction of the Registrar (Judicial) of this Court. The Applicant wants to replace the Solvent Surety for the reasons mentioned in the Application.

Considering the pleadings and the prayer clause, the Application is allowed in terms of prayer clause 'B'. It is made clear that, only after fresh Solvent Surety / Security is tendered to the satisfaction of the Registrar (Judicial) of this Court and same is accepted, the earlier Solvent Surety / Security would stand discharged. 5.

The Application stands disposed off.
