Heard the learned counsel for the applicant, however, none appears for respondent no.1-original claimant though duly served. The learned counsel for the respondent no.2 absent. For the reasons stated in the civil application, delay of 57 days caused in filing the first appeal is hereby condoned. Civil application is allowed and accordingly disposed of.

The learned counsel submits that, the entire amount under the award is already deposited before the Commissioner. In view of this the stay granted earlier stands confirmed. Civil application for stay is accordingly disposed of. 3.
