In all these writ petitions, the grievance raised is that the caste certificates issued to the petitioners of belonging to Koli- Mahadev Scheduled Tribe were tried to be submitted before the Caste Scrutiny Committee for its verification. However, the Caste Scrutiny Committee have insisted that the petitioners should submit the caste certificates in Form "C" postulated under the Maharashtra Act No.XXIII of 2001. The petitioners accordingly have requested the respondent/Sub Divisional Officer, Majalgaon, District Beed to issue the caste certificates in Form "C"

4 935,936,938 to 940, 942 to 946.WP.13541.25.odt as contemplated under the Maharashtra Act No. XXIII of 2001. However, the same has not been issued and, therefore, these writ petitions. 2.

After hearing the parties, we are of the considered view that the prayers made in the writ petitions are reasonable and capable of being granted. Therefore, we pass the following order :

ORDER

(i) The respondent/Sub Divisional Officer, Majalgaon, District Beed is directed to issue corrected tribe certificates in Form "C" in favour of the petitioners to be belonging to Koli-Mahadev Scheduled Tribe within a period of one month from today, subject to petitioners surrendering the original tribe certificate which is in incorrect form. (ii) We also make it clear that, if the earlier caste certificates of the petitioners are surrendered before the respondent/Sub-Divisional Officer, before issuing corrected tribe certificates in Form "C" he should also test the genuineness of issuance of earlier caste certificates. (iii) Writ Petitions stand disposed of.
