The learned counsel for the appellants/claimant Mr. Mohit R. Deshmukh along with appellants, Mr. A.B. Gatne, learned counsel for respondent No.3 along with representative of respondent No.3 namely Mr. Indris Khan, Assistant Manager, National Insurance Co. Ltd are present today.

With the assistance of the learned counsel, we have ascertained identification of the appellant and respondent No.3. They affirms the terms of settlement.

The learned counsel and the parties who are present have placed on record the terms of compromise. Same is taken on record and marked as Exhibit-X for identification.

As per the terms of settlement Exhibit-X, the respondent No.3 shall deposit an addition amount of Rs. 7,00,000/- (Rupees Seven Lakh) towards the full and final settlement between the parties within the stipulated period as agreed between them. The same shall be treated as an undertaking. On depositing the amount, the appellant/ claimant is permitted to withdraw the same.

The learned counsel for the respective sides and parties are present today have agreed that an additional amount stated above shall be deposited in the Motor Accident Claim Tribunal, Aurangabad instead of High Court as stipulated in paragraph No.5 of the terms of the settlement Exh. "X".

The appellant shall pay the deficit court fees, if any, within a period of three weeks from today.

8.

The payment of deficit court fees, if any shall be the condition precedent to withdraw the amount.

9.

The first appeal stands disposed of in terms of the settlement Exhibit-X and present minutes of order.

-310. Award be drawn up accordingly.
