Heard the learned advocate for the petitioners in all these petitions as also the learned advocate Mr. Tope for the University. 1/3

The petitioners who are the students of the B.Sc. Forensic Science and Cyber Security College are aggrieved by cancellation of their performance in respect of all the subjects of B.Sc.- I, II and III year. 3.
On the last date, we had requested the learned advocate for the University to take instructions, since performance in respect of all the subjects for the respective semesters/years were cancelled without considering the provision regarding allowing to keep the terms. 4.
The learned advocate for the University, on instructions, produces the minutes of the meeting held on 04.11.2023 under Section 48(5)(C) of the Maharashtra Public Universities Act, 2016. Those minutes are taken on record.

As can be seen, the earlier decision has been recalled in respect of the students who were not seen to have indulged in copying as per the report submitted by Dr. B.B.Waykar Committee. Their results were decided to be declared permitting them to appear for the next examination to be conducted in November-December 2023. It was also resolved that wherever the students were seen to have resorted to copying, their performance in the concerned subject only has been cancelled. It has also been resolved that if they are eligible to appear for next semester/year, they should be permitted to do so in the November-December-2023 examination. They are also permitted to appear afresh for the subject in respect of which their performance has been cancelled.

In the light of such a decision, the learned advocate for the petitioners, on instructions, submits that nothing survives and the petitions can be disposed of, however, according to him there are around 300 petitioners and if some one is aggrieved, liberty be granted to such of those to challenge even the recent decision and the petitions can be disposed of. 7.
We dispose of the writ petitions having become infructuous, granting 2/3
liberty to the individual petitioners to resort to appropriate remedy in accordance with law.
