The applicant - wife is seeking transfer of Petition A No.400/2018 filed by respondent- husband for restitution of conjugal rights, from the Family Court, Nashik to the Family Court at Aurangabad.

According to the applicant-wife, the respondent was initially a permanent resident of Moharda, Taluka -Kannad, DistrictAurangabad but as the dispute started, he shifted to Nashik and started doing business of auto-rikshaw. However, the learned counsel

for the respondent made candid statement on record that the respondent -husband has again started residing at Moharda village. As such, it seems that he can easily attend the proceedings at Family Court, Aurangabad instead of Family Court, Nashik. In view of the same, following order is passed :

ORDER

(i) The application is hereby allowed.

(ii) The Petition A No. 400/2018 pending in the Family Court, Nashik is transferred to the Family Court at Aurangabad for disposal, according to law.

(iii) The respondent is directed to appear before the Family Court at Aurangabad on or before 15/07/2023.
